Waste Material - Customer represents and warrants that the materials placed in the equipment shall be "waste material" as defined herein and shall contain no other substances. The term "waste material" as used in these Terms and Conditions shall mean solid waste generated by Customer excluding radioactive, volatile, highly flammable, explosive, biomedical, infectious, toxic, or hazardous material. The term "hazardous material" shall include, but not be limited to, any amount of waste listed or characterized as hazardous by the United States Environmental Protection Agency or any state agency pursuant to the Resource Conservation and Recovery Act of 1976, as amended or applicable by law. Title to and liability for any waste excluded above shall remain with Customer and Customer expressly agrees to defend, indemnify and hold harmless Contractor from and against any and all damages, penalties, fines and liabilities resulting from or arising out of such waste excluded above.
Driveways and Parking Areas - customer warrants that any access / location provided for contractor's equipment is sufficient to bear the weight of all equipment and vehicles required to perform the service. Contractor shall not be responsible for damage to any private pavement or accompanying sub-surface or any route reasonably necessary to perform the services herein contracted.
In addition, Contractor shall not be responsible for damages to lawns fences, or shrubbery. Customer assumes all liabilities for damage to pavement or road service, lawns, fences, and shrubbery.
The customer is responsible for where the container is placed. Make the driver aware of any special precautions or delivery instructions at the time of service to protect the customers property from potential damage.
Customer is solely responsible for the care and maintenance of all property owned by the Company and its contents. Customer agrees to indemnify and hold harmless the Company from and against any and all claims for loss or damage to property or injury and/or death of a person or persons arising from Customer's use of the equipment furnished under this Agreement. Customer agrees that they are solely responsible for all damages to and remunerations for Company's property.
Neither party shall be liable for failure to perform under this Agreement due to contingencies beyond its reasonable control included, but not limited to, strikes, riots, or acts of nature.
Disclaimer - Due to the uncertain soil conditions and sub surface terrain, Diamond Disposal cannot be held responsible for any damage to customer driveways, curbs, lawns or walks, wells and septic systems. It is the customer's responsibility to make Diamond Disposal aware of any underground utilities, which might be affected by taking delivery of the dumpster/container.
Due to inclement weather, traffic conditions, mechanical breakdowns and availability of containers, we cannot guarantee delivery times or dates.
Delivery dates are Monday through Friday (Saturday when available).
Customer is liable for additional fees for container over allowable weight limit. For details on fees and conditions please call 860-599-8661.
Deposit is due prior to delivery of the container.
